End-User License Agreement

1. Agreement to Terms

This End-User License Agreement ("EULA") is a legal agreement between you ("User") and Tradie Safe Pro ("we", "our", or "the Company") governing your use of the Tradie Safe Pro software application and all associated services (collectively, the "App"). By accessing or using the App, you agree to be bound by this EULA. If you do not agree, do not use the App.

2. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the App solely for your internal trade business purposes in accordance with these terms.

3. Restrictions

You must not:

• Copy, modify, distribute, sell, or lease any part of the App or its source code
• Reverse-engineer or attempt to extract the source code of the App
• Use the App for any unlawful purpose or in violation of any applicable law or regulation
• Misrepresent safety documentation, quotes, or invoices generated through the App
• Share your account credentials with unauthorised persons

4. Intellectual Property

The App, including all content, design, code, and materials, is the exclusive property of Tradie Safe Pro and its licensors. This EULA does not transfer any ownership or intellectual property rights to you. All rights not expressly granted are reserved.

5. User-Generated Content

You retain ownership of the content you create within the App (quotes, invoices, safety documents, project data). By using the App, you grant us a limited licence to store and process that content solely to provide the App's services to you.

6. Third-Party Integrations

The App integrates with third-party services including QuickBooks Online (Intuit Inc.), Xero, HubSpot, Salesforce, Google, Stripe, and Facebook/Instagram, and others. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the conduct of those third-party services.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranty of any kind. We do not warrant that the App will be uninterrupted, error-free, or free from viruses. Safety and compliance documents generated by the App are templates to assist you — they do not constitute legal or professional safety advice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Consumer rights preserved: Nothing in this EULA excludes, restricts, or modifies any non-excludable consumer rights, guarantees, or remedies provided to you by mandatory local law, including the Australian Consumer Law, EU/UK consumer protection law, and US federal and state consumer protection statutes. Where such rights apply, our liability is limited to resupplying the App or paying the cost of having it resupplied, as permitted by law.

9. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with its terms. Upon termination, you must cease all use of the App. Provisions that by their nature should survive termination shall survive.

10. Governing Law

This EULA is governed by the laws of the State of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria, Australia.

11. Updates to this EULA

We may update this EULA from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised terms. We will endeavour to notify users of material changes via the App.
